General Terms and Conditions for the Sale by Trésors-Trouvés

By using this website and/or placing an order you agree to be bound by the terms and conditions set out below.
Unless specifically agreed upon in writing between T-T and you, the customer, no other terms and conditions will apply.
T-T may change the terms without notice to the customer. Changes will apply to any subsequent orders received.
These terms and conditions are subject to change without prior written notice in Trésors-Trouvés sole discretion.

1. Offer
1.1 Offers by T-T are not binding. 1.2 Specifications and quotes in catalogues, brochures, etc., on the T-T website are only binding if expressly referred to in the order confirmation. All dimensions are given in centimeters; inch dimensions are approximative, rounded to 0.5 inch. 1.3 The offer must not be reproduced nor disclosed to third parties without T-T consent. 1.4 T-T has made every effort to display as accurately as possible the colours of our products that appear on the website. However, as the actual colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery.

2. Registration and Order Procedure for sales via Internet
2.1 Detailed information on how to get access to T-T online services and how to place a legally binding order can be found on the website. 2.2 Acceptance of the order is confirmed when T-T has sent an email order conformation to the customer, however this can only be done after customer and T-T have agreed on a method of transportation.
2.3 In case the ordered product is not available, T-T will get in touch with the customer as soon as possible.

3. Customer's responsibilities
3.1 In order to provide a smooth communication flow between the customer and T-T the customer is obliged to: a) Provide T-T with true and accurate information during the registration process (e.g. company name, address, e-mail address). b) Inform T-T immediately about any changes in the information mentioned above. c) Ensure that messages can be transmitted to his e-mail address and that such messages can be received and read at any time during normal business hours.
d) T-T reserves the right to check the status of customers outside of Europe to protect its own legal and financial status.

4. Prices
4.1 Prices shown on the login section of the T-T website are Tax-free whole-sale prices.
4.2 Prices are binding in Euros, the currency converter gives an indication of the prices in other currencies.
4.3 The pricing assumes sales outside the EU and does not include BTW/VAT.
European customers and private collectors should contact T-T directly for pricing information. 4.4 The prices mentioned on the invoice for European customers include BTW/VAT but this is not shown on the invoice because of the use of The Marge system (European tax law for Antiques.)
4.5 If a sale occurs to a non-European customer who likes to obtain the goods within Europe without proper export-papers, this sale will be treated by T-T as a European sale (Marge system)
4.6 Prices are based on the material and labour costs valid at the time of the first offer. Any changes to these costs prior to the date of delivery entitle T-T to change prices accordingly.
4.7 Prices are based on the antique items, all display material included with the items is for free .

5. Delivery and Dispatch
5.1 T-T cannot be held responsible for damages to the products or loss of products during transport. If there is any proven responsibility for damages by T-T, the maximum compensation to be claimed will be the amount of the order.
5.2 T-T will not ship goods to consumers within the Netherlands, customer will be able to collect the goods by appointment at our location in Amsterdam or where otherwise agreed on. 5.3 T-T will treat all their products against vermin, and will do this to the best of T-T knowledge; however T-T will never be held responsible when this did not show to be sufficient or adequate. T-T is able to advise with regard to the use of pesticides. 5.4 T-T cannot be held responsible for late delivery by transport-companies or postal services or for delays caused by permits required for delivery in the customer's country that do delay the delivery of the products. The customer is responsible to obtain these permits in the country of delivery. 5.5 Terms and obligations of delivery are suspended as long as the customer's payments are in arrears. 5.6 T-T is entitled to carry out and invoice partial or preliminary shipments. 5.7 The agreed delivery periods are subject to force majeure, or unforeseen events or events beyond the control of T-T, such as war, Acts of God, governmental interventions and bans, energy and raw material shortages, strikes, transport damages or delays.

6. Sale of Goods and Transfer of Risk
6.1 Unless otherwise agreed in writing, costs and all risks are transferred to the customer at the time of dispatch of the goods from T-T warehouse. 6.2 If delivery is delayed by the customer, transfer of costs and risk shall become effective
when the goods are ready for dispatch. In this case the delivery shall be considered as performed.

7. Payment
7.1 Payment is required in euros and only by bank-wire transfer
7.2 The bank-wire transfer costs have to be totally assumed by the customer.
7.3.1 If there has been no payment (after the agreement) received within 7 days, we reserve the right to cancel the order.
7.3.2 There will be no shipment before payment.
7.3.3 Until the customer has fulfilled all financial obligations, the goods supplied shall remain T-T property.

8. Warranty
8.1 Unless otherwise agreed in writing there will be no warranty period applicable as our products are antiques. Slight nicks and scratches are possible but serve to add to the product’s charm and uniqueness.
8.2 notwithstanding the above, before dispatching all products will be meticulously checked by T-T. Should there nevertheless be reason for a claim about a product, please email T-T, info@tresorstrouves.com explaining the claim. T-T will react by telephone or email.
T-T will judge the claim, and we will in case of a lawful claim refund at most the amount paid excluding the transport costs.

9. Returns and exchanges
9.1 T-T does make every effort to inform customers as accurately as possible about their products. If a product is nevertheless proven unsatisfactory, it may in certain cases be returned or exchanged, however this will be judged on a case by case basis
9.2 The customer must inform T-T by email at info@tresorstrouves.com within 7 days of receiving the products that they wish to return them, stating the reason.
9.3 T-T does reserve the right to lower the credit by 25% to cover the cost induced by T-T.
9.4 Reduced articles cannot be returned or exchanged.
9.5 The products must be returned in their original condition, undamaged and in the original packaging.
9.6 The customer is responsible for the cost of returning products. Products must be returned carriage paid, if not they will not be accepted by T-T.
9.7 The credit amount paid will be refunded within 30 days.
9.8 Returns or exchanges do only apply for sales to private consumers and not for wholesale sales.

10. Liability
10.1 T-T cannot be held responsible for wrongful use of one of their products.
10.2 T-T cannot be held responsible for any direct or indirect damages occurring in any way after the products have been delivered. This applies to the customer as well as to any third parties.

11. Copyright and Privacy
11.1 All rights, including copyright, in this website are owned by or licensed to T-T. Any use of the site or its contents, including copying or storing it or them in whole or in part, other than for your own personal, non-commercial use is prohibited without the written permission of T-T.
11.2 Your data will enable us to process and fulfil your order and will be stored in our database. This information will never be passed to third parties.

12. Place of Jurisdiction, Applicable Law
12.1 In case of legal proceedings in which T-T is a party, only Dutch law is applicable.
